Terms of Purchase

These Terms of Purchase ("Terms of Purchase") govern your purchases of products and services available at https://novaminceur.com/ (the "Company Sites" or "Sites"). The Company Sites are operated by novaminceur.com (the "Company"). Your use of the Company Sites and these terms are also governed by the Terms of Use and Privacy Notice, which are incorporated by reference.

PLEASE READ THESE TERMS OF PURCHASE, TOGETHER WITH THE TERMS OF USE, PRIVACY NOTICE AND ANY OTHER POLICIES OR AGREEMENTS REFERENCED HEREIN, CAREFULLY BEFORE PURCHASING OR USING PRODUCTS OR SERVICES THROUGH THE COMPANY SITES. BY PURCHASING OR USING PRODUCTS OR SERVICES THROUGH THE COMPANY SITES, YOU ACCEPT THESE TERMS OF PURCHASE, INCLUDING, WITHOUT LIMITATION, THE ARBITRATION AGREEMENT AND CLASS ACTION WAIVER DESCRIBED IN THE DISPUTE RESOLUTION SECTION REFERENCED BELOW.

General

These Terms of Purchase are entered into and delivered by you and constitute a valid and binding agreement between you and the Company, enforceable in accordance with their provisions. You represent that you are (1) at least 18 years old; (2) of legal age to enter into a binding contract; and (3) not prohibited from receiving services under applicable laws, rules or regulations.

You must purchase and use the products and services offered through the Company Sites in strict compliance with these Terms of Purchase and all applicable laws, rules and regulations (collectively, "Laws"). You are responsible for complying with all laws applicable to your purchase, including those in the jurisdiction to which the products are delivered. Calls, emails and other communications between you and the Company may be recorded.

Privacy Notice

A copy of the Privacy Notice applicable to the Company's collection, use, disclosure and other processing of personal information is available at https://novaminceur.com. You consent to personal information we may obtain about you, whether through the Company Sites, email, telephone or other means, being collected, stored and processed according to the Privacy Notice. The Company may update its Privacy Notice from time to time at its sole discretion. Changes will be published on the Company Sites. By continuing to use the Sites after changes are made, you accept those changes.

Purchases

Order Processing

The Company may, at its sole discretion, decide not to process or to cancel an order in certain circumstances, including where the requested product or service is out of stock or incorrectly priced, where fraud is suspected, or in other circumstances the Company considers appropriate. The Company may also take steps to verify your identity to process your order. The Company will not charge you, or will refund charges, for orders it does not process or cancels.

Without limiting the foregoing, the Company reserves the right to (i) withdraw any stated offer, (ii) correct errors, inaccuracies or omissions, and (iii) change prices, content, promotional offers, product descriptions or specifications and other information without an obligation to publish notice of the changes (including after an order has been submitted, acknowledged, dispatched or received, unless prohibited by law).

Product and Service Descriptions

The Company seeks to provide accurate descriptions of products and services on the Company Sites. However, it does not guarantee that descriptions are accurate, complete, reliable, current or free from error. If a product or service offered on the Sites is not as described, your sole remedy under these Terms of Purchase is to return the item as described herein.

The Company Sites may offer a quick-view function for various products. This function lets you see pricing information and add products to your basket without opening the full product page. Quick view and add-to-basket functions are offered for convenience only. More detailed product information, including origin, features and pricing, is available on the product page.

Pricing Information

The Company aims to provide accurate prices for products and services available on the Company Sites but cannot guarantee that pricing errors will not occur. The Company reserves the right, at its sole discretion, not to process or to cancel any order placed for a product or service incorrectly priced on the Site because of an error. In that event, the Company will notify you by email. The Company also reserves the right to correct any error in the stated total selling price.

Product and Service Availability

The Company Sites may contain availability information used to estimate whether an item is likely to be dispatched promptly after your order. The estimated delivery date for an item at its destination address will be approximately 30 days or less after payment, but may vary according to stock shortages, adverse weather, carrier transit time, destination address and other factors.

Unfortunately, the Company cannot guarantee that an item marked "in stock" will be dispatched immediately, as stock levels can change significantly from day to day. On rare occasions an offer may be in stock when an order is placed but unavailable when we attempt to process it. In that case we will notify you by email. Out-of-stock service offerings are generally no longer available. If the Company determines that a product or service you wish to purchase is no longer available, the item will be cancelled from your order; the Company will notify you by email and remove the item from the Sites.

Product-Specific Disclaimers and Additional Obligations

In addition to the general disclaimers in the Terms of Use, products and services bought through the Site: (a) may not include manufacturers' warranties, even when a warranty is available for a product or service elsewhere; (b) may not include service or support options; (c) may not have manuals, instructions or safety warnings in your native language or the language of certain destination countries; (d) may not be designed to meet the standards, specifications and labelling requirements of your jurisdiction; and (e) may not comply with the electrical voltage or other electrical standards of your jurisdiction, potentially requiring an adaptor or converter. You agree that it is your responsibility to research a product to ensure it meets your needs and may lawfully be imported into your jurisdiction.

Taxes

You are responsible for all taxes, customs duties and charges levied by the jurisdiction to which products are shipped, including but not limited to sales or use taxes, value-added tax and tariffs.
